How long will the accident claim take?
When we meet with a potential client who was involved in a motor vehicle collision, we tell them there are basically two parts to the case. There is the claims side of your case which can be up to a 2-year period. There is a 2-year statute of limitations from the day of your wreck, which is a fancy legal term for time limit. You have 2 years to get your case settled to your satisfaction with the insurance company. If you can’t get your case done during the claim phase, or you want to get your case done but the insurance company is not taking your claim seriously, then you have to look at the 2nd phase of the case, which is putting the case into litigation, filing a lawsuit. When a lawsuit is filed, it can exponentially increase the time of the claim.
Challenges with insurance companies and accident claims
Working with insurance companies on accident claims if full of challenges. One of the first things an insurance company will do, if they can, is deny. For example, if you are involved in a motor vehicle accident where someone ran a red light while you had a green light, the insurance company will try and twist it to say that you ran the red light. Then they will say their client was not at fault, that you were so they are not going to pay anything.
When insurance companies can’t deny outright, they will try and blame your injuries on something else. For example, if you sustained a broken arm or back injury from the collision, the insurance company will ask to see medical records from before the accident to try and pin the injuries on some other event rather than the auto collision.
If the insurance company can’t deny the claim outright or pin the injuries on another event, the next thing they will try is to take issue with the treatment you received for your injuries. They will try things like saying you waited too long to get treatment for your injuries, or they will say you received too much treatment, and they will only honor a certain amount of the claim.
While this is a cliché, it is truly a David vs. Goliath type of battle from start to finish when working with insurance companies and personal injury claims.
