Challenges Involved with Eye Injury Cases

There are many challenges involved with eye injury cases. As with all cases related to personal injuries we have to prove liability, is there someone who is at fault for the injury. Additionally, we have to prove damages which occurred as a result of the liability. With traumatic eye injuries often it is not difficult to show that there is an injury to the eye related to the incident in question. The challenges in these cases is proving who is responsible for the eye injury and what are the damages. Regarding damages, we have to consider the long term effects of the injury: do you have reduced or loss of vision in one eye or blindness? Do you require corrective surgery or special glasses?

When dealing with vision issues or vision loss related to concussion or traumatic brain injury it can be much more difficult to prove liability and damages because it is difficult to demonstrate the injury. We can’t present a scan or x-ray which shows the vision issue and that it was the result of the accident. In some cases, if a client has a good history of visiting their eye doctor and there is a record of good eye exams and now we have a vision problem, those eye exam records can be helpful in demonstrating there is a vision problem.
