In every personal injury case, there are other people who have their hands in the settlement money “pot”. When you look at all the medical providers and their bills and insurance entities that have paid money on claims that are involved in the case, they all have their hand in the “pot”. Like all personal injury attorneys, we only getting paid on what we collect, so what incentive is there for us to deal with these other people trying to take money out of the “pot”?
Attorneys that work in the personal injury field work on a contingent basis, they take 1/3 of what they collect. At first blush that seems fine, all attorneys are working on the same playing field. But, at the end of the day that’s not true.
If an attorney calls a client and says, “Good News, we settled your case for a million dollars” the client might say, “wow, that’s pretty good”. But the attorney says, “we have to pay out a million and one”, the client might be a little confused by that and think “what’s that mean for me in the end?” If you’re paying out more than what was brought in, the client doesn’t get anything.
Personal injury attorneys are all working for the same contingent fee of 1/3. If you are working with a law firm that is a large advertiser there is a queue of people out the door coming in; they are just serving you like McDonald’s. They are giving you your money and taking their 1/3 and you are stuck paying the bills and fighting with the medical and insurance people down the road.

It is common that by the point we are cutting checks for a client on a case that has recently been resolved to be in a position where we have substantially reduced what needs paid out. Often, we successfully negotiate the reduction of bills to medical providers and eliminate some of the health insurance subrogation claims because they truly do not have a right to be paid back. This takes time and effort to work through all that but in the end, the client will get way more money in their pockets by our efforts, yet we are not paid any more for doing that!
This is how we like to do business at Willis, Willis & Rizzi. That’s how we work hard for people. It isn’t necessarily how much money do you get to settle the case, but how much money you get in your pocket at the end of the case. There is a lot that goes on in that battle. First, there is a battle to get the money, and then there is a battle to save the money.

We do not want a line of people out the door, we don’t advertise for that – that’s not our style. The large law firms that spend heavily on advertising take in hundreds of cases a week, and they tell their lawyers that means we must get a hundred cases out the door. They deal in volume or quantity – not quality.
Moving hundreds of cases out the door like the big advertisers do doesn’t provide enough time to deal with the legal issues of saving money nor does it give clients the service that we think they deserve.
